POTTER COUNTY, Texas (KVII) — A 28-year-old Amarillo woman was acquitted of the murder of a man in May 2018, attorneys said Friday.
Desiray Burks was acquitted of a first-degree murder charge on Thursday in the 108th District Court in Potter County, according to the Sixth St. Law Office.
Burks was charged with shooting and killing Garyan Cain, 26, on May 5, 2018. She was arrested and charged the next day.
Following her arrest, Burks was held in the Potter County Jail for about two and a half years, her attorneys said.
The criminal complaint and indictment claimed she shot Cain but testimony during the four-day trial revealed Cain confronted Burks with his semi-automatic pistol and a struggle occurred.
The prosecution's pathologist confirmed the cause of death was a bullet to the lower neck.
