A Southeast Texas jury will hear more from a deputy who investigated the shooting death of a drunk driver who killed two boys - a killing for which the boys' father is on trial.

The testimony comes Wednesday in the second day of the murder trial of David Barajas (bah-RAH'-hahs). He's accused of fatally shooting Jose Banda in December 2012 minutes after Banda plowed into a vehicle that Barajas' two sons had been pushing on a rural road. Twelve-year-old David Jr. died at the scene and 11-year-old Caleb died at a hospital.

A prosecutor told the Brazoria County jury Barajas took the law into his own hands and publicly executed Banda in a fit of rage. However, the defense attorney contends Barajas didn't kill Banda.

READ MORE: "No weapon was recovered and no witnesses have identified Barajas as the shooter."
