Driver in crash that killed 5 'Texas' members confirmed drunk


oxicology reports confirm that the driver, 20-year-old Clinton Diaz, was legally drunk at the time of the crash.

According to the Texas Department of Safety, Diaz's blood alcohol level was .165 which is double the legal limit in the state of Texas which is .08.

DPS also said that one of the toxicology reports indicate the presence of marijuana in Diaz's system.

Diaz and five others were inside the vehicle at the time of the wreck. Diaz, Andrew Duncan, Amanda Starz, Julian Arredondo, and Eric Harrison were killed in the wreck and Timothy Johnson was critically injured.

Johnson is still in the hospital in satisfactory condition. The driver of the other vehicle, Theron Arthur McSay has since been released from the hospital.
